TERMS AND CONDITIONS
Volunteers for Camp Rosenbaum hereby agree to the following:
1. Voluntary Participation. Volunteers are not considered employees of Camp Rosenbaum, and shall not be entitled to the following:
1.1. Compensation or remuneration for services; or
1.2. Employee Benefits, including without limitation, insurance provided against bodily harm.
2. Assumption of Risk. Camp activities may be inherently dangerous and may expose volunteers to a variety of foreseen and unforeseen hazards and risks. Camp Rosenbaum shall not be held liable for such risks, including any and all risk of injury, harm, or loss incurred as a result of volunteer participation.
3. Background and Criminal Check. Any involvement as a volunteer at Camp Rosenbaum is contingent upon a clean criminal history check pursuant to the information provided in this application. Any misrepresentation of fact in this application may be grounds to terminate further consideration for a volunteer position with Camp Rosenbaum, or if volunteer service has already begun, may be cause for release.
4. Anti-Harassment Policy. Camp Rosenbaum strictly prohibits and does not tolerate unlawful harassment against and among volunteers or any other covered persons because of race, religion, creed, national origin, ancestry, sex (including pregnancy), gender (including sexual orientation, gender identity, and status as a transgender or transsexual individual), age, physical or mental disability, citizenship, genetic information, past, current, or prospective service in the uniformed services, or any other characteristic protected under applicable federal, state, or local law. This list is illustrative only, and not exhaustive. No form of harassment will be tolerated.
4.1. Reporting Procedure. Camp Rosenbaum is committed to enforcing this policy against all forms of harassment. However, the effectiveness of our efforts depends largely on the affected and/or witnessing individuals alerting us to inappropriate conduct. If volunteers feel that they or someone else may have been subjected to conduct that violates this policy, they should immediately report it to either their direct supervisor or an authorized employee of Camp Rosenbaum.
4.2. Violations of the Policy. If, upon thorough investigation of the facts and circumstances of the claim, Camp Rosenbaum determines any covered person has subjected an individual to harassment in violation of this policy, they will be subject to discipline, up to and including termination of their position.
4.3. Litigation Costs. In the event that a volunteer commences legal action for enforcement of the Anti-Harassment Policy or to remedy its breach, the prevailing party in such action shall be entitled to recover its actual attorney’s fees and other costs incurred in the action, in addition to such other to which it may be entitled.
5. Non-Threatening Conduct Policy. Camp Rosenbaum values a collaborative and respectful environment. To maintain a positive atmosphere and foster constructive communication, all volunteers agree to refrain from threatening to initiate legal action against any coworker in any context related to their employment. This includes, without limitation, verbal or written threats of lawsuits or legal claims. Any volunteer who feels aggrieved should first utilize the Reporting Procedure outlined in section 4.1 of these Terms and Conditions to resolve disputes amicably. Engaging in threats of legal action against coworkers may result in disciplinary action, up to and including termination of employment. This policy is not intended to restrict actions protected or required by state or federal law.
6. Indemnification. Volunteers agree to indemnify, defend, and hold harmless the entity known as Camp Rosenbaum from any and all liability, losses, damages, judgments, or expenses, including attorneys' fees, that it may incur or sustain as a result of any and all bodily injury, sickness or property loss/damage sustained while serving as a volunteer.
BY SIGINING BELOW, I, VOLUNTEER, ACKNOWLEDGE AND AGREE:
1. All statements made by me on this application are true and correct to the best of my knowledge;
2. This position is voluntary, and Camp Rosenbaum will not compensate me for my services or participation;
3. This position may involve activities that expose me to both foreseen and unforeseen hazards and risks. I expressly and specifically assume such risks, including without limitation, injury, harm, or loss that I may incur as a result of my participation;
4. This position is contingent upon a clean criminal record in accordance with section 3 of the Terms and Conditions;
5. I agree to comply with all policies stated in the Terms and Conditions, and all other applicable policies and procedures of Camp Rosenbaum;
7. I understand that my signature constitutes a formal release and discharge of Camp Rosenbaum from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that may arise from my participation as a volunteer at Camp Rosenbaum; and
8. I understand that if I do not agree with any of the above terms and conditions, Camp Rosenbaum will be unable to accept my application at this time. My form submission will be received but will not be processed.
